Terms of Service

1. Acceptance of Terms

By accessing or using logodetekt ("Service"), operated by logodetekt ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

logodetekt is a software-as-a-service (SaaS) platform that provides AI-powered logo detection and brand visibility analytics for images and video content. The Service uses machine learning models to identify and track logos within user-uploaded media, providing analytics and reporting on brand exposure.

3. Account Registration

To use the Service, you must create an account using a supported third-party authentication provider (e.g., Google). You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

You represent that the information you provide during registration is accurate and complete, and you agree to keep it current. We reserve the right to suspend or terminate accounts that contain inaccurate or incomplete information.

4. Acceptable Use

You agree not to use the Service to:

  • Upload, process, or store any content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable.
  • Infringe upon the intellectual property rights of any third party.
  • Upload content containing child sexual abuse material (CSAM) or any content that exploits minors.
  • Attempt to gain unauthorized access to the Service, other accounts, or any related systems or networks.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Use the Service for any purpose that is illegal or prohibited by these Terms.
  • Reverse engineer, decompile, or disassemble any aspect of the Service.
  • Use automated means (bots, scrapers, etc.) to access the Service without our written consent.

5. User Content

You retain all ownership rights to the content you upload to the Service ("User Content"). By uploading User Content, you grant us a limited, non-exclusive license to process, analyze, and store your content solely for the purpose of providing the Service to you.

We do not use your User Content to train machine learning models. All AI inference is performed using Amazon Bedrock, a fully managed service that does not use customer inputs for model training or improvement. Your content is processed in real-time and is not retained by the AI model provider.

You are solely responsible for your User Content and represent that you have all necessary rights and permissions to upload and process it through the Service.

6. Data Security and Infrastructure

The Service is built on Amazon Web Services (AWS) infrastructure. All data is encrypted in transit using TLS 1.2+ and at rest using AES-256 encryption. User-uploaded files are stored in Amazon S3 with server-side encryption enabled. Database services are provided by Supabase with encrypted connections.

While we implement industry-standard security measures, no method of electronic transmission or storage is 100% secure. We cannot guarantee absolute security of your data.

7. Subscription and Billing

The Service offers both free and paid subscription tiers. Free tier accounts are subject to usage limits as described on our pricing page. Paid subscriptions are billed in advance on a recurring basis (monthly or annually) through Stripe, our third-party payment processor.

You may cancel your subscription at any time through the Stripe customer portal. Cancellations take effect at the end of the current billing period. We do not provide refunds for partial billing periods unless required by applicable law.

We reserve the right to modify pricing with 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

8. Intellectual Property

The Service, including its original content, features, and functionality, is owned by the Company and is protected by international copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that the results obtained from the Service (including logo detection accuracy) will be accurate or reliable. Logo detection results are generated by AI models and should not be relied upon as the sole basis for business decisions without independent verification.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE COMPANY, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Service, your User Content, or your violation of these Terms.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. We will make reasonable efforts to allow you to export your data before deletion, but are not obligated to retain your data after account termination.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
